Admitted Case of Liability Dismissed on Strength of Opening Statement
Mr. Wager-Smith defended an endodontist who admitted that he had performed an apicoectomy on the patient’s wrong tooth. The patient alleged the surgery had been performed without anesthesia and resulted in the development of a complex regional pain syndrome in the orofacial region. The patient also alleged that she was totally disabled as a result of the chronic pain. The patient’s husband joined the suit, alleging his wife’s injury had caused the loss of sexual relations between them.
Dentist Prevails In Lawsuit Over Rest and Lunch Breaks
Mr. Wager-Smith represented a dentist who was sued by a former employee for alleged rest and meal break violations. Specifically, the former employee accused the dentist of denying her the opportunity to take rest and lunch periods.
Seller Sues Buyer – Our Client Awarded Nearly $500,000
Mr. Wager-Smith defended an oral surgeon who purchased a Northern California practice and was subsequently sued by the seller. The seller claimed our client had breached the purchase agreement by failing to pay a portion of the purchase price. After analyzing the purchase, we filed a cross-complaint alleging that the seller had failed to disclose the fact that top referral sources had stopped referring patients to the practice prior to the sale.
